1. Agreement to these terms
By accessing or using TopServ, you agree to these Terms of Service and our Privacy Policy. If you use TopServ for an organization or game server, you represent that you have authority to bind that organization. If you do not agree, do not use the service.
You must be at least 13 years old to use TopServ. If you are under the age of legal majority where you live, a parent or guardian must approve your use. You must be legally able to enter a binding agreement to purchase TopServ Max.
2. Accounts and security
Authentication is provided through Clerk. You are responsible for accurate account information, safeguarding access to your account, and activity carried out through it. Notify us promptly if you believe your account or a server-team invitation has been compromised.
You may not sell accounts, impersonate another person or organization, evade a suspension, or use automated accounts to manipulate votes, reviews, reports, or analytics.
3. Listings, reviews, and acceptable conduct
Server owners are responsible for their listings, uploaded images, social links, connection details, voting rewards, and claims about their communities. You must have the rights and authorization needed to publish that content and operate the listed server.
You may not submit or promote content that:
- is unlawful, fraudulent, deceptive, defamatory, or infringes rights;
- contains malware, credential theft, abusive redirects, or unsafe downloads;
- facilitates harassment, exploitation, hate, or sexual content involving minors;
- publishes private information or exposes an address contrary to game safety practices;
- artificially manipulates votes, reviews, player counts, uptime, or rankings; or
- interferes with TopServ, its security, rate limits, or other users.
Reviews must reflect genuine experience. We may investigate reports, remove content, limit visibility, suspend listings, or terminate accounts when we reasonably believe these terms or applicable law have been violated. Verification indicates completion of TopServ’s verification process, not an endorsement or a guarantee that a server is safe.
4. Votes, connections, and rewards
Standard voting is limited to one vote per account for a server during each voting week. TopServ Max Vote Rallies may reset the applicable cooldown as described in the product. We may reject or remove fraudulent, automated, purchased, coordinated, or otherwise manipulated activity.
Direct-connect links open services operated by server owners or game platforms. TopServ does not operate those servers and is not responsible for their availability, rules, purchases, moderation, or content. In-game rewards are offered and fulfilled by the relevant server owner. TopServ records and exposes reward claims to that owner but does not guarantee delivery or value.
5. TopServ Max and billing
TopServ Max is currently offered at the price shown at checkout per server per month. Subscriptions renew automatically until canceled. Stripe processes payment details, receipts, taxes where applicable, subscription changes, and cancellations. You may manage or cancel through the billing portal; cancellation generally takes effect at the end of the paid billing period unless checkout or applicable law states otherwise.
Max features can include a claimable promoted week, Vote Rallies, reward tools, and advanced analytics. A promotion increases placement opportunities but does not guarantee impressions, votes, players, revenue, or any particular ranking. Promotional benefits must be claimed and used within the periods shown in the product. Except where required by law, partial billing periods and unused benefits are not refundable.
6. Service changes and availability
We may improve, change, limit, or discontinue features. Status checks, player counts, rankings, analytics, and third-party integrations can be delayed or inaccurate. We do not promise uninterrupted service and may perform maintenance or take emergency security action without advance notice.
7. Content license and intellectual property
You retain ownership of content you submit. You grant TopServ a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and distribute that content solely to operate, secure, market, and improve TopServ. This license ends when the content is deleted, except for reasonable backups, legal retention, and material already shared outside the service.
TopServ’s software, brand, design, and original content are protected by intellectual-property laws. These terms do not grant permission to copy the platform, scrape it at scale, or use TopServ branding in a way that suggests endorsement.
8. Disclaimers and limitation of liability
To the fullest extent permitted by law, TopServ is provided “as is” and “as available” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not endorse or control listed servers or user content.
To the fullest extent permitted by law, TopServ and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or harm arising from third-party game servers. Our aggregate liability for a claim will not exceed the greater of the amount you paid TopServ during the six months before the event giving rise to the claim or US $25. Some jurisdictions do not allow certain exclusions, so these limitations may not apply to you.
9. Indemnity
To the extent permitted by law, you agree to defend and indemnify TopServ and its operator from claims, losses, and reasonable costs arising from your listings, rewards, server operations, violation of these terms, or infringement of another person’s rights.
10. Suspension, termination, and disputes
You may stop using TopServ at any time. We may restrict or terminate access when needed to enforce these terms, protect users, comply with law, prevent harm, or preserve platform integrity. Provisions that by their nature should survive will remain effective after termination.
Before filing a formal claim, you agree to contact us and make a good-faith effort to resolve the issue informally. These terms are governed by the law applicable where TopServ’s operator is established, without overriding consumer protections that cannot legally be waived in your home jurisdiction.
11. Changes to these terms
We may update these terms as TopServ changes. We will update the effective date and provide additional notice when a material change requires it. Continued use after the updated terms take effect constitutes acceptance where permitted by law.
